Public Complaints

The following is information about the role of the Public Complaints Commissioner, according to the Local Authorities (Public Complaints Commissioner) Law, 5768-2008, and how to contact him. It should be noted that this information does not replace the provisions of the law.

Any person is entitled to file a complaint with the Public Complaints Commissioner.

The Local Authority and its institutions, an employee, an office holder or a person holding a position in the local authority, as well as a supervised municipal body, an employee, an office holder or a person holding a position therein.

A complaint shall be about a matter relating to the performance of the respondent's duties. The act must satisfy both of the following conditions:

  1. The act was performed in contravention of the law or without legal authority or in contravention of proper administration, or it was excessively harsh or manifestly unjust.
  2. The act directly harms or prevents a benefit to the complainant himself or to another person.

If the act harmed another person or prevented him from receiving a benefit, the complainant must obtain that person's consent to file a complaint to the satisfaction of the Public Complaints Commissioner.

The following are examples of acts that can be complained about to the Public Complaints Commissioner:

  • Discrimination in enrollment in educational institutions, placement in a kindergarten far from the place of residence when there is a place in a kindergarten closer to home.
  • Failure to bring a request for a building permit to the Planning and Building Committee for discussion.

The Public Complaints Commissioner will examine the complaints in accordance with the provisions of the law and notify the complainant in writing of the results of the investigation.

Complaints that will not be investigated by the Public Complaints Commissioner, even if the act meets the two conditions above:

  1. Complaints regarding matters pending in court or tribunal, or which have already been decided by a court or tribunal.
  2. Complaints that the Public Complaints Commissioner considers to be harrasing or frivolous.
  3. A complaint about a judicial or quasi-judicial action.
  4. A complaint by an employee regarding a matter relating to his or her employment, but there will be an investigation into an act that deviates from the provisions of the law, regulations, collective agreement, or general arrangements established by law.
  5. Complaints regarding matters that have already been submitted to the State Comptroller in his capacity as Public Complaints Commissioner under the State Comptroller Law, 1958 [Consolidated Version].
